ARTICLE 11: Applicable law and competent jurisdiction
French law applies to this contract. In the event of a dispute, the parties shall seek an amicable solution. Failing that, and subject to the mandatory jurisdiction rules applicable to consumers, the courts of Lyon have jurisdiction.
ARTICLE 12: Publication by the User
The site allows members to post comments and descriptions for their servers.
In his publications, the member undertakes to respect the rules of Netiquette and the rules of law in force.
The site moderates publications a posteriori and reserves the right to refuse their posting or to remove them, under the conditions set out in article 5.
The member remains the holder of all of his intellectual property rights. But by publishing a publication on the site, it cedes to the publisher the non-exclusive and free right to represent, reproduce, adapt, modify, disseminate and distribute its publication, directly or by an authorized third party, worldwide, on any medium (digital or physical), for the duration of the intellectual property. The Member notably assigns the right to use its publication on the internet and on mobile telephone networks.

ARTICLE 13: Voting rules, account creation and fraud prevention
Participation in votes offered on the site is strictly regulated.
Each user is authorized to cast one (1) vote every two (2) hours, this limitation being applicable per user and/or per IP address.
It is strictly forbidden to circumvent or attempt to circumvent the voting rules, in particular by:
- the use of bots, scripts, automated software or any third-party service, free or paid, offering to automate or delegate votes;
- the use of VPNs, proxies or anonymization services;
- the creation or use of multiple accounts, including through the abusive use of similar or incremented usernames (e.g. username1, username2, username3, username100);
- any other maneuver aimed at artificially increasing the number of votes.
Any abusive, fraudulent or diverted use of the voting system, whether automated or manual, is prohibited.
In the event of fraud or attempted fraud, the publisher reserves the right, without prior notice, to:
- cancel part of the server's votes;
- suspend or delete one or more user accounts;
- restrict or block access to the site, in particular by IP address filtering or by any automated security measure (verification challenge, request rate limiting, user agent filtering);
In the event of repeated fraud, manifest abuse or voluntary and recurring circumvention of voting rules, the publisher reserves the right to withdraw, delist or permanently delete the server concerned from the service, without prior notice or compensation.
Except for purely technical and temporary measures, the User or the owner of the server concerned is informed of the sanction and its reason, and may contest it by writing to [email protected]; the request is reviewed by a member of the team.
The owner of a server is responsible for the votes received for the benefit of their server, whatever their origin, including when they come from a third-party service to which they have subscribed or of which they are aware. The sanctions provided for in this article apply to them even if they did not personally cast the fraudulent votes.
The publisher also reserves the right to take any civil or criminal action against the authors, providers and promoters of automated voting methods, in particular on the basis of Articles 323-1 et seq. of the French Criminal Code relating to attacks on automated data processing systems.
